Divorce is not the end of the world.

It is change that disrupts our lives the most. Although a difficult and somewhat taboo mater to discuss, divorce happens everyday to all different types of people, people with children and people without children. There are many different reasons people divorce their spouse including:

  • infidelity
  • gambling
  • drinking
  • drug problems
  • personality incompatibility
  • abuse just to name a few.

Because divorce can be difficult for children to deal with sometimes people will put off the inevitable but will eventually feel the need to get out of the marriage or risk suffocation.

Usually people wait quite some time before taking the plunge to file divorce. Most states in the United States are called no fault divorce states. This means that due to no fault of either party to the marriage a divorce may be granted as long as one party believes the marriage to be irretrievably broken or the parties have irreconcilable differences. The decision to file divorce is a difficult one to arrive at. But once a person realizes the marriage is over the effects of the divorce filing are easier to deal with.

The division of assets and debts, child support, custody and placement and alimony (maintenance) are some of the major issues involved in divorce cases. Some states are what may be referred to as community property states and some are separate property states. Whether your state is a community property or separate property state will determine whether there will be an equal division of assets and debts.

When children are involved divorce cases are usually more complicated since child custody, placement and most importantly support become a major issue in the case, especially if young children are involved.

If the parties can agree on most or all aspects of dissolving the marriage their divorce case can be finished in a much shorter time than parties who do not agree on most if not all issues involved in the divorce (contested divorce). There is a waiting period by which you can be divorced and to which you can remarry after the divorce. Many times parties believe they will agree about matters and they soon find out they don’t. Divorce is adversarial, to some degree.

Although a child’s wishes may be considered by the court, regarding who they wish to live with, the courts usually employ a legal standard called “the best interests of the children” to decide custody and placement issues.

Once a divorce case is finalized it is rare that the case can be re-opened to discuss matters already decided by the parties or the court. It is for this very reason that having an attorney represent you in your divorce case is both important and vital.
